The Uncontested Divorce
Generally, an uncontested divorce is the simplest and most cost effective means of dissolving a marriage. On the 61st day after the required "cooling off period", an uncontested divorce can be granted when spouses agree:
• To be divorced
• To the division of all property
• To child support and custody provisions (when children are involved)
During the uncontested divorce, the divorce attorney files all the necessary documents with the court. Immediately following the 60 day waiting period, the divorce is "proved up" in front of the Judge. Family Court proceedings can be intimidating.
